Notice of Amendment to the OTS Agreements
Dear Participants in the Used Tires Program,
This announcement serves as notice of changes Ontario Tire Stewardship (OTS) has made to the existing Participant Agreements in accordance with the “Amendment” section of the Agreement. You will find the new Agreements attached here and posted in the Collector Resources, Hauler Resources, Processor Resources, and RPM Resources sections of this website.
As you know the Ontario tire recycling market has changed dramatically since the Used Tires Program (UTP) was launched in September of 2009, and OTS has been working to ensure the program evolves to better serve the needs of the market. OTS has been consulting on the revisions to the Agreements since July of 2013, and the Agreements have been updated to incorporate the important and constructive feedback received from stakeholders during this process. The changes are designed to allow OTS greater flexibility to adjust the design and application of the incentives offered under the UTP, provide greater clarity to stakeholders on their obligations under the Agreements and the program, and enhance the contractual tools at OTS’s disposal to enforce a level playing field for all tire recycling industry players.
As per the Amendment section of the Agreements this announcement shall serve as formal notice to UTP Participants of such change (the “Change Notice”). Unless you give notice to OTS (the “Rejection Notice”) within 45 days of receipt of this Change Notice that you not accept the revisions or amendments in the Change Notice, this Agreement, as amended, remains in effect and is binding. If you give a Rejection Notice to OTS, this Agreement may be terminated 30 days after your delivery of the Rejection Notice and you may be deregistered from the UTP and thus be ineligible for any incentives offered by OTS under the UTP.
While not specifically required under the Agreement, OTS will be seeking the return of signed copies of the revised Agreements from stakeholders. Please print out the Agreement, sign and return to OTS at your earliest convenience. OTS will then counter sign and return a copy to you for your records. Signed Agreements may be e-mailed to info@rethinktires.ca, faxed to 866-884-7372 or mailed to 300 The East Mall, Suite 100, Toronto, Ontario, M9B 6B7. Notwithstanding the desire by OTS to have duly signed and executed Agreements on-file, the terms of the revised Agreements come into force 45 business days following the issuance of this Change Notice, that date being May 5th, 2014.
Should you elect to reject the changes in the revised Agreement please send your Rejection Notice to OTS by e-mail to info@rethinktires.ca, by fax to 866-884-7372 or by mail to 300 The East Mall, Suite 100, Toronto, Ontario, M9B 6B7 no later than May 5th 2014.
